Whether you’re applying for maintenance, changing an order, or reporting non-compliance, the forms below are official documents used in South African maintenance courts. Download them, fill them out carefully, and submit them to your nearest Maintenance Court.

These forms help individuals protect their rights and ensure proper financial support through the legal system, in terms of the Maintenance Act 99 of 1998.

Form A — Application for Maintenance Order

Use this if: You are applying for maintenance for yourself and/or your child(ren).
This is the first step to begin a legal claim for child or spousal support. You’ll provide details about the person responsible for maintenance, as well as your income, expenses, and needs.

Form B — Substitution or Discharge of Maintenance Order

Use this if: You already have a maintenance order and want to change or cancel it.
This form is used when circumstances have changed—such as increased expenses or improved/lost income—and a new maintenance amount must be requested, or the order should end.

Form G — Consent & Maintenance Order

Use this if: Both parties agree in writing on the terms of maintenance.
This allows for a consent-based order to be made without going to court. It’s quicker and often easier when both parties want to formalise a maintenance agreement legally.

Form I — Variation or Setting Aside of a Default Order

Use this if: A default order was made without your presence, and you want to change or cancel it.
If you missed your maintenance court date and a default order was granted, use this form to ask for that decision to be reviewed.

Form K — Enforcement of Maintenance Order

Use this if: You have a valid maintenance order and the other party is not paying.
This form lets you apply for legal enforcement through one of three methods: a warrant of execution, garnishee order (salary deduction), or debt attachment.

Form M — Setting Aside a Warrant of Execution

Use this if: You have a valid maintenance order and the other party is not paying.
This form lets you apply for legal enforcement through one of three methods: a warrant of execution, garnishee order (salary deduction), or debt attachment.

Form N — Suspension/Amendment of Emoluments Order

Use this if: You want to change or stop a salary deduction order made against you.
This form helps you approach the court for a fair review based on changes in your employment or personal circumstances.

Form P — Suspension/Amendment of Debt Attachment Order

Use this if: There is a debt attachment order against you and you want to challenge or modify it.
Commonly used when banks or third parties are ordered to deduct money from your account to pay maintenance.

Form Q — Complaint of Failure to Comply

Use this if: The other person is ignoring a maintenance order.
You can formally report their non-compliance and initiate legal steps to enforce payment or bring them before court for contempt.
